Terms of Use

These Terms of Use (“Terms”) govern your access to and use of proofofposition.org and related services (the “Service”) provided by Proof of Position (“POP”, “we”, “us”). By using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be 18 years or older and legally able to enter into a binding contract to use the Service. By creating an account you confirm that you meet these requirements.

2. Your account

  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • You must provide accurate information when creating your account and maintaining your profile.
  • You agree not to misrepresent your identity, employment history, or credentials.

3. Verified content and Trust Scores

POP enables you to add information to your profile and to invite independent verification of that information. You agree that:

  • Information you submit must be accurate and not infringe on the rights of others.
  • Verification responses from peers and other sources are their own statements; POP does not endorse or independently audit every claim.
  • Trust Scores are computed from inputs we receive. They are informational and do not constitute a guarantee of fitness for any role or any other professional outcome.
  • We may correct, downweight, or remove information that is disputed, fraudulent, or otherwise inconsistent with these Terms.

4. Acceptable use

You agree not to:

  • Submit false, misleading, or impersonated information.
  • Submit verification requests to people you did not actually work with, or coerce verification responses.
  • Scrape, mass-export, or build derivative databases from public profiles without our written permission.
  • Use the Service for spam, harassment, or any unlawful purpose.
  • Attempt to bypass security or access non-public parts of the Service.

5. Employer use

Employer accounts may access candidate information subject to their subscription, candidate visibility settings, and applicable law. Employers must:

  • Use candidate information only for legitimate hiring purposes.
  • Not redistribute candidate data beyond their own hiring team.
  • Comply with all applicable employment, anti-discrimination, and data protection laws.

6. Subscriptions and billing

Some features require a paid subscription. Pricing, billing cycle, and renewal terms are set out at checkout. You may cancel at the end of the current period. Refunds are at our discretion except where required by law.

7. Intellectual property

The Service, including the POP brand, software, and design, is owned by us. You retain ownership of the content you submit. By submitting content you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and process it solely to operate and improve the Service.

8. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that harms users or POP. Termination does not affect rights and obligations that survive by their nature (e.g. accrued payment obligations, indemnities).

9. Disclaimers

The Service is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or that any specific hiring outcome will result from its use. Trust Scores are informational signals — they are not a guarantee of any professional fact.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to these Terms or the Service is limited to the amount paid by you to us in the twelve months preceding the claim, or ZAR 1,000 if greater. We are not liable for indirect or consequential losses including loss of employment, business, or reputation.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa. Disputes will be referred to the courts of South Africa, subject to any applicable consumer protection rights.

12. Changes

We may update these Terms. Material changes will be communicated via the Service or by email. Continued use after the changes take effect constitutes acceptance.
